EVENING COURSE TERMS AND CONDITIONS

  1. INTERPRETATION

In these Conditions, the following definitions apply:

“Advertising Channels” all methods of advertising and social media used by FKF.
“Agreement” or “Contract” all clauses contained within this contract.
“Carer” or “Guardian” person who attends the course or any part of it, with the pupil.
“Coach” individual(s) employed by the Company to deliver any and all parts of the course.
“Code of Conduct” or “Session Rules” set of understood regulations that the Parent and Pupil agree to follow upon enrolment.
“Company” First Kick CIC delivering the course and the party entering into the contract with the Parent.
“Continuous Payment Authority” Authority for FKCIC to take recurring Fee’s from a payment card.
“Course” “Enrolment Form” form completed by the Parent upon enrolment of the Pupil on the course.
“Fee” monetary cost to cover admission onto the course and starter kit as specified on the Enrolment Form.
“New Customers” pupils and/or parents/guardians attending a FKF class for the first time.
“Parent” parent or legal guardian responsible for payment of Fees and the party entering the contract with the Company.
“Pupil” the child attending the course as specified upon enrolment by the Parent.
“Stadium” the venue where the course is being held.
“Terms” terms and conditions set out in this contract and any special terms and conditions agreed in writing by FK and the parent.
  1. ACCEPTANCE OF TERMS AND CONDITIONS
    1. This contract states all agreements between both parties; FKF and the Parent. The Terms shall be considered final and agreed upon payment of the Fee by the Parent. Fees paid by anyone else on behalf of the Parent, shall be deemed to have consent from the Parent and will therefore be acting on their behalf.
    2. Any additional agreements between both parties, shall be deemed to be accepted by the Parent if not contested within 30 days of verbal or written notice by FKF.
    3. No other variation of these Terms shall be binding unless agreed in writing by FKF and the Parent.
    4. The Parent or guardian agrees to keep the content of all FKF sessions confidential, including all marketing and delivery of the Course for any commercial purposes. Upon agreement of these Terms, the Parent agrees not to directly or indirectly manage, operate or assist in the organisation of any business that competes with FKF while the Pupil is enrolled at FKF or for a period of two (2) years following their final attendance of a FKF Course.
    5. In the event of a Parent failing to abide by these Terms, a customer may be requested to discontinue with FKF. In this instance, FKF will be under no obligation to provide a refund for any future Courses.
  1. ACCEPTANCE OF TERMS AND CONDITIONS
    1. First Kick Football is a trading name of First Kick CIC, a community interest company registered in England with the company number 15651813. Our registered office address is 9A Hennel Lane, Walton Le Dale, Preston, PR5 4LA.
    2. All correspondence from FKF shall be via Text (including WhatsApp), telephone, email, verbally or by the postal address provided upon Enrolment. The Parent accepts responsibility to update all contact information with the Company and FKF shall not be held responsible for any undelivered correspondence due to incorrect contact details.
    3. In booking any course, the parent agrees to be contacted by any of the communication methods above (see clause 3.2) regarding any related services. If for any reason a parent does not wish to be contacted via any of the methods above (clause 3.2), they must notify FKF by emailing info@firstkickfootball.co.uk.
  1. BOOKING, PAYMENT & CANCELLATION
    1. Booking a Course
      1. Courses may be booked online via www.firstkick.co.uk or via telephone to First Kick CIC.
      2. All confidential data supplied by the Parent shall be managed by FKF, whose data privacy policy can be found by visiting www.firstkick.co.uk/privacy or via request by email to info@firstkickfootball.co.uk.
      3. All Course information is correct at the time of publishing. All Course locations and times shall be communicated to the Parent following booking.
      4. Once booked, the Parent agrees to all the Terms included in this contract, including the Code of Conduct.
      5. All of our prices include any standard VAT where applicable.
    2. Payment, Changes & Cancellation
      1. Lessons are paid in two instalments; the first upon enrolment and the second no later than at the first class prior to starting the Course.
      2. All Course Fees are non-refundable. However, refunds or credits may be issued in limited circumstances as outlined in the First Kick Refund and Credit Policy, available at www.firstkick.co.uk/refund-and-credit-policy/. This policy sets out the conditions under which such refunds or credits may apply before or during a Course. Parents are encouraged to review this policy prior to booking.
      3. FKF shall not be held responsible for any cancellations or changes caused by events outside its reasonable control, including but not limited to adverse weather, venue issues, illness, or other unforeseen circumstances. In such cases, refunds or credits will be managed in accordance with the Refund and Credit Policy.
      4. FKF will provide the Parent with as much notice of any course changes/cancellations as is reasonably possible but shall not be liable for any costs incurred by any party arising from such circumstances.
      5. FKF reserves the right to cancel this contract at any time and for any reason. In the event that FKF cancels a Course in full, a full refund (including any deposit) will be issued in accordance with the Refund and Credit Policy.
      6. FKF cannot guarantee sessions run in consecutive weeks. Any sessions cancelled by FKF, shall be re-arranged until the number of sessions to complete the Course are undertaken. FKF reserve the right to offer a pro-rated refund if such re-arrangement is not possible.
      7. Should an insufficient number of children be booked on your session (FKF’s discretion), alternative Courses shall be offered in its place or a refund will be provided.
  1. The Parents Responsibility
    1. The parent warrants and represents that:</strong
      1. The information provided upon Enrolment is entirely accurate and should any information change, it is the Parent’s responsibility to notify FKF immediately.
      2. Any persons whatsoever attending a FKF stadium, are not suffering from any contagious illness, disease, injury or anything similar thereto.
      3. FKF Courses may require Carer participation. It is the Parent’s responsibility to inform the Coach of any condition of their own or the Pupil in attendance, that could affect their capability of partaking in the session. All information will be kept confidential and should be supplied by calling First Kick CIC or notifying your Coach at the Stadium.
      4. The Parent acknowledges and agrees that the Pupil shall de deemed to be under the direction of the Coach whilst at the Stadium.
      5. In attending a course or liaising with any staff under the employment of FKF whatsoever, Parents, Pupils and Carers are responsible for following all Session Rules (see Clause 6).
      6. FKF has the right to exclude any Pupil, Carer, Parent or attendee of an FKF Stadium for any reason FKF (in their discretion) for any duration FKF deem reasonable (in their discretion) for any reason whatsoever.
      7. Sibling’s of Pupil’s are permitted to attend Stadium. It is the Carer’s responsibility to ensure they do not partake in any sessions unless enrolled on a class. The Parent accepts that sibling’s do have to abide by any Session Rules and FKF reserve the right to act in accordance with Clause 5.16 of this agreement.
  1. Session Rules
    1. All Pupils or siblings should always be fully supervised by the Carer when arriving and leaving a Stadium.
    2. The Carer is responsible for arriving on time to all sessions and must inform FKF if they need to leave the session early for any reason.
    3. Any siblings, bags, buggies or similar should always be kept as far back as possible from the playing area . Any children not enrolled on the course are not covered under FKF’s insurance if they cause or are involved in an accident by entering the playing area.
    4. Pupil’s may at times, be asked to sit out for a short ‘time-out’ period to calm down. We ask that Carer’s assist us in supervising the child during this period.
    5. Any litter should be taken and disposed of at the end of the session.
    6. Bring plenty of water and/or still juice for the session. Please do not bring any food to avoid the risk of choking.
    7. FKF follow FA guidelines with regards to photography at our Courses http://www.thefa.com/football-rules-governance/safeguarding/best-practice-downloads.
      Whilst the FA encourage taking photographs of children participating in sporting activities and it is not an offence for you to take a photograph of your child during the Course, photographs containing any of the following should not be shared on social media:

      1. Other children (unless consent is provided by the Parent)
      2. Names of other children other than your own (unless consent is provided by the Parent)

      Any breach of this policy should be reported to your coach or by calling First Kick CIC.

      FKF may use photo’s taken by the Coach or Parent’s for marketing purposes, unless the Parent notifies FKF in writing to info@firstkickfootball.co.uk.

    8. No requests or transfers shall be guaranteed for children to change class times/Stadiums with the Coach. Any changes must be made by contacting First Kick CIC.
  1. Complaints Procedure
    1. Whilst we always strive to provide the best service possible, should you have any need to make a complaint, please follow our complaints procedure:
      1. Speak to the Coach at the Stadium initially. If your matter is not resolved to your satisfaction, please call First Kick CIC on the phone number provided (see Clause 4.1.1) or by writing (see Clause 3.2).
  1. Website & Social Media Information
    1. The material made available on our website or on any form of associated Advertising Channels, including materials in linked sites directly or indirectly accessible from this site, are provided ‘as is’, with no warranty of any kind, express or implied, including those of merchantability and fitness for a particular purpose. Any reference to linked sites or to third party companies, products or services by name does not constitute or infer its endorsement by FKF. FKF has used all reasonable endeavours to ensure that information provided through this website and all Advertising Channels is accurate at the time of inclusion, however it accepts no liability for any inaccuracies, errors or omissions in the site. The information on the site or Advertising Channels may be incomplete, out of date or inaccurate. FKF reserves the right at any time and without prior notice to make changes and corrections to the material on the site. FKF cannot guarantee that access to the site will be available at all times and there may be periods where information is unavailable, in which instance any information can be obtained by writing (see Clause 3.2). FKF accepts no liability for any loss or damage of whatsoever nature caused by the use or the inability to use the materials available in this site or any linked site. FKF has taken all reasonable steps to ensure that the Intellectual Property of this parties is not infringed. If however, you genuinely believe that the material on this site or Advertising Channels infringes any intellectual property rights, please contact First Kick CIC directly. All images displayed on this website are under the ownership of the photographer concerned. Agreement to display the photographs has been reached and they are not available to be copied.
  1. Exclusion of Liability
    1. Except in the case of fraud, FKF, its coaches, servants, employees or agents accept no responsibility under any circumstances for any loss (consequential or otherwise), damage, expense or delay suffered or incurred by the Parent, the Pupil or any other party arising directly or indirectly or in any way connected with the attendance of the Pupil at the Course (or any part of it) or any other act or omission on the part of FKF or any of its coaches, employees or agents even if such act or omission is negligent.
    2. The parent agrees (for and on behalf of the Parent and the Pupil) that any claim by the Parent or the Pupil against FKF or any coach, employee or agent of FKF must be brought within 60 days of the event that gave rise to such claim. Any claim made thereafter shall be time-barred.
    3. The Parent acknowledges, warrants and undertakes (for and on behalf of the Parent and the Pupil) that the maximum aggregate liability of FKF to the Parent and/or Pupil under these terms shall not exceed the Fee.
    4. All warranties and conditions whether implied by statute or otherwise are excluded from this contract provided that nothing in this contract shall restrict or exclude liability for death or personal injury caused by the negligence of FKF, its coaches, servants, employees or agents or affects the statutory rights of the Parent or Pupil.
  1. GENERAL
    1. In partaking in any FKF Course, the Parent acknowledges they are bound by the terms of this contract and any associated policy documents on https://www.Firstkick.co.uk/policydocuments.
    2. Whilst we try to ensure Courses have the same Coach for every class, for various reasons we cannot guarantee this. We will always ensure that the Coach running your class will be competent in delivering the Course to a standard befitting of a FKF Coach.
    3. Assignment and subcontracting:
      1. FKF may at any time assign, transfer, charge, subcontract or deal in any other manner with all or any of its rights under the Contract and may subcontract or delegate in any manner any or all its obligations under the Contract to any third party or agent.
      2. The Parent shall not, without the prior written consent of FKF, assign, transfer, charge, subcontract or deal in any other manner with all or any of its rights or obligations under the Contract.
    4. Notices:
      1. Any notice or other communication required to be given to a party under or in connection with this Contract shall be in writing and shall be delivered to the other party personally or sent by prepaid first-class post, recorded delivery or by commercial courier, at its registered office (if a company) or (in any other case) its principal place of business, or such other address as notified by the other party from time to time, or sent by email to the other party’s main email address;
      2. Any notice or other communication shall be deemed to have been duly received:
      3. if delivered personally, when left at the address referred to in clause 2;
      4. if sent by pre-paid first-class post or recorded delivery, at 9.00 am on the second Working Day after posting, or if delivered by commercial courier, on the date and at the time that the courier’s delivery receipt is signed; or
      5. if sent by email, one hour after transmission provided that the sender does not recall the message or receive notification of non-delivery or if the email is sent outside of core business hours (09:00 am to 16:00 pm), 10 am on the next Working Day.
    5. Waiver:
      1. A waiver of any right under the Contract is only effective if it is in writing and shall not be deemed to be a waiver of any subsequent breach or default. No failure or delay by a party in exercising any right or remedy under the Contract or by law shall constitute a waiver of that or any other right or remedy, nor preclude or restrict its further exercise. No single or partial exercise of such right or remedy shall preclude or restrict the further exercise of that or any other right or remedy;
      2. Unless specifically provided otherwise, rights arising under the Contract are cumulative and do not exclude rights provided by law.
    6. Severance:
      1. If a court or any other competent authority finds that any provision of the Contract (or part of any provision) is invalid, illegal or unenforceable, that provision or part-provision shall, to the extent required, be deemed deleted, and the validity and enforceability of the other provisions of the Contract shall not be affected.
      2. If any invalid, unenforceable or illegal provision of the Contract would be valid, enforceable and legal if some part of it were deleted, the provision shall apply with the minimum modification necessary to make it legal, valid and enforceable.
    7. No partnership: Nothing in the Contract is intended to, or shall be deemed to, constitute a partnership or joint venture of any kind between any of the parties, nor constitute any party the agent of another party for any purpose. No party shall have authority to act as agent for, or to bind, the other party in any way.
    8. Third parties: A person who is not a party to the Contract shall not have any rights under or in connection with it.
    9. Variation: Except as set out in this Contract, any variation, including the introduction of any additional terms and conditions, to the Contract, shall only be binding when agreed by FKF.
    10. Governing law and jurisdiction: This Contract, and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims), shall be governed by, and construed in accordance with, English law, and the parties irrevocably submit to the exclusive jurisdiction of the courts of England and Wales.

IMPORTANT BOOKING NOTICE 

Holiday Club Bookings are for services taking place on specific dates, at specific Venues and during specific periods. 

Where a Booking relates to sports, leisure or recreational activities provided on a specific date or during a specific period, the statutory 14-day cancellation or cooling-off period that may apply to some online or telephone purchases does not apply. 

Where that legal exemption does not apply to a particular Booking, the Parent/Carer will retain any cancellation rights provided by law. 

Holiday Club Bookings are normally non-refundable once booked because places are reserved for specific Children, dates, Venues and Sessions, and First Kick CIC may commit staffing, Venue and operational costs based on confirmed Bookings. 

Nothing in these Terms affects any refund, cancellation right or other remedy that a Parent/Carer is legally entitled to. 

First Kick CIC may, at its discretion, allow a Booking to be transferred to another Holiday Club where: 

  • the request is received at least 7 days before the booked Session or programme starts; 
  • a suitable alternative place is available; and 
  • staffing, capacity, eligibility and funding arrangements allow the transfer. 

Transfers are not guaranteed. 

Choosing Klarna, Tax-Free Childcare, childcare vouchers or another payment method does not change First Kick CIC’s Booking, transfer, cancellation or refund policy. 

Parents/Carers must check the date, Venue, Session time, programme type and Child’s details carefully before completing a Booking. 

A late collection charge of £1 per minute, per Child applies after the advertised closing time. 

INTRODUCTION 

These Terms and Conditions apply to all First Kick CIC: 

  • holiday clubs; 
  • football camps; 
  • sports camps; 
  • paid childcare provision; 
  • HAF programmes; 
  • SEND provision; 
  • community holiday activities; and 
  • other school holiday programmes delivered by First Kick CIC. 

By making a Booking, paying for a place, accepting a Funded Place, completing a booking form, confirming attendance or allowing a Child to attend a First Kick CIC Holiday Club, the Parent/Carer confirms that they have read, understood and accepted these Terms and Conditions. 

These Terms are designed to provide clear information to Parents/Carers while supporting the safe, fair and efficient operation of First Kick CIC Holiday Clubs. 

Parents/Carers should read these Terms before completing a Booking. 

 

KEY BOOKING TERMS AT A GLANCE 

Cooling-off period 

Where a Booking relates to sports, leisure or recreational activities taking place on a specific date or during a specific period, the statutory 14-day cooling-off period does not apply. 

Where that exemption does not apply, the Parent/Carer retains any cancellation rights provided by law. 

Refunds 

Holiday Club Bookings are normally non-refundable once booked because places are reserved and First Kick CIC may commit staffing, Venue and operational costs based on confirmed Bookings. 

This does not affect any refund or other remedy required by law. 

Transfers 

First Kick CIC may, at its discretion, allow a Booking to be transferred where the request is received at least 7 days before the booked Session or programme starts. 

Transfers are subject to availability, staffing, capacity, eligibility and funding rules and are not guaranteed. 

Klarna and other payment methods 

Choosing Klarna, Tax-Free Childcare, childcare vouchers or another payment method does not change First Kick CIC’s Booking, transfer, cancellation or refund policy. 

Any approved refund will normally be returned through the original payment route. 

Booking checks 

Parents/Carers must check the date, Venue, programme, Session time, age group and Child’s details before completing a Booking. 

Illness and non-attendance 

A refund will not normally be provided for illness, injury, non-attendance, a change of plans, booking errors, attending the wrong Venue, arriving late or leaving early. 

Late collection 

A charge of £1 per minute, per Child applies after the advertised closing time. 

Behaviour 

Unsafe, aggressive, discriminatory or repeated disruptive behaviour may result in removal from the Holiday Club or refusal of future Bookings. 

Medical conditions and SEND 

Parents/Carers must provide full and accurate medical, allergy, medication, SEND and additional-needs information before attendance. 

Toileting and personal care 

Any toileting, continence or personal-care support must be disclosed and agreed before attendance. 

 

  1. DEFINITIONS

In these Terms and Conditions, the following definitions apply. 

“First Kick”, “we”, “us” or “our” means First Kick CIC and any trading name used by First Kick CIC, including First Kick and First Kick Football. 

“Parent”, “Carer” or “Guardian” means the adult with legal responsibility for the Child, the adult making the Booking, or the adult responsible for payment and communication with First Kick CIC. 

“Child” means the child attending the Holiday Club. 

“Holiday Club” means any holiday club, football camp, childcare Session, HAF programme, SEND programme, sports activity, community activity or school holiday provision delivered by First Kick CIC. 

“Venue” means the school, sports facility, community Venue, leisure facility, playing field, indoor space or other location where a Holiday Club is delivered. 

“Booking” means the place reserved for the Child at a Holiday Club. 

“Session” means a single day, half-day, funded Session, activity period or booking slot within a Holiday Club. 

“Fees” means the amount payable for the Booking. 

“Funded Place” means a place funded by a local authority, HAF programme, school, grant funder, partner organisation or another third party. 

“Policies” means First Kick CIC’s safeguarding, behaviour, health and safety, first aid, medication, complaints, SEND, data protection, adverse weather, photography and video, missing child, uncollected child, intimate care and any other relevant policies or procedures. 

“Booking System” means First Kick CIC’s website, online booking platform, payment platform, local authority system or any other approved method through which a Booking may be made. 

 

  1. WHO WE ARE

First Kick CIC is a community interest company delivering sports coaching, football Sessions, holiday clubs, community programmes and childcare-related activities. 

First Kick CIC is registered in England and Wales with company number 15651813. 

Our registered office is:

Preston
PR5 4LA 

Some Holiday Clubs may be: 

  • Ofsted-registered; 
  • local authority funded; 
  • HAF funded; 
  • school partnered; or 
  • delivered under an applicable childcare registration exemption. 

This will depend on the Venue, age group, programme type and Session length. 

Where a Holiday Club is Ofsted-registered or subject to local authority, school or funder requirements, First Kick CIC will operate in accordance with the relevant registration, safeguarding, health and safety and welfare requirements. 

 

  1. ACCEPTANCE OF TERMS

The Parent/Carer accepts these Terms and Conditions when they: 

  • make a Booking; 
  • pay for a Booking; 
  • accept a Funded Place; 
  • complete an online or paper booking form; 
  • confirm that their Child will attend; or 
  • allow their Child to attend a Holiday Club. 

These Terms apply alongside any relevant: 

  • booking information; 
  • confirmation email; 
  • welcome information; 
  • Venue rules; 
  • funding conditions; 
  • programme-specific requirements; and 
  • First Kick CIC Policies. 

The Parent/Carer is responsible for reading these Terms before completing a Booking. 

If the Parent/Carer does not agree with these Terms, they must not complete the Booking or allow the Child to attend. 

No variation to these Terms will apply unless confirmed in writing by an authorised representative of First Kick CIC. 

Nothing in these Terms removes or restricts any right or remedy that cannot legally be removed or restricted.  

 

  1. BOOKING INFORMATION

Holiday Club places must be booked in advance through: 

  • the First Kick CIC website; 
  • First Kick CIC’s Booking System; 
  • the First Kick CIC office; 
  • an approved local authority system; 
  • an approved school or partner system; or 
  • another booking method authorised by First Kick CIC. 

The Parent/Carer must check the following information carefully before completing a Booking: 

  • the Holiday Club date; 
  • the Venue; 
  • the programme type; 
  • the advertised age or school-year range; 
  • the Session start and finish times; 
  • the Child’s name and date of birth; 
  • the Child’s eligibility for the programme; 
  • emergency contact details; 
  • collection permissions; 
  • medical information; 
  • allergies and dietary requirements; 
  • SEND or additional needs; 
  • personal-care or toileting requirements; 
  • medication requirements; and 
  • photography and video preferences. 

The Parent/Carer is responsible for ensuring that all information supplied is accurate, complete and up to date. 

A paid Booking is not confirmed until the required payment has been received. 

A Funded Place is not confirmed until the place has been approved through the relevant funding or eligibility process. 

First Kick CIC may refuse, pause, amend or cancel a Booking where: 

  • essential information has not been provided; 
  • payment has not been received; 
  • funding eligibility cannot be confirmed; 
  • incorrect or misleading information has been provided; 
  • the Child does not meet the relevant age, school-year or programme requirements; 
  • required support arrangements have not been agreed; 
  • the Venue or programme has reached capacity; or 
  • First Kick CIC cannot safely meet the Child’s needs based on the information available. 

Where practical, First Kick CIC will explain the reason for refusing, pausing, amending or cancelling a Booking. 

 

  1. AGE AND ELIGIBILITY REQUIREMENTS

Children must fall within the advertised age or school-year range on the date of attendance unless First Kick CIC agrees otherwise in writing. 

The Parent/Carer is responsible for booking the Child into the correct programme and age group. 

First Kick CIC may refuse or amend a Booking where: 

  • the Child does not fall within the advertised age range; 
  • the Child does not meet the relevant school-year requirement; 
  • the Child does not meet funding or eligibility criteria; 
  • the programme is unsuitable for the Child’s age or needs; or 
  • accommodating the Child would create a safety, safeguarding, staffing or regulatory concern. 

Where a Booking has been made for an ineligible Child, any refund or transfer will be considered in accordance with the cancellation provisions in these Terms and applicable consumer law. 

 

  1. FEES AND PAYMENT

Paid Holiday Club places must be paid for in full at the time of Booking unless First Kick CIC agrees otherwise in writing. 

All prices will be displayed before the Booking is completed. 

Prices may vary according to: 

  • Venue; 
  • date; 
  • programme type; 
  • Session length; 
  • funding arrangement; 
  • promotional offer; or 
  • booking method. 

Where childcare vouchers, Tax-Free Childcare or third-party payments are accepted, the Booking will only be confirmed once payment has been received and allocated to the correct Child and Booking. 

The Parent/Carer is responsible for: 

  • using the correct payment reference; 
  • allowing sufficient time for payment to be received; 
  • providing any information needed to allocate the payment; and 
  • checking that payment has been completed successfully. 

First Kick CIC is not responsible for delays caused by: 

  • an incorrect payment reference; 
  • incomplete payment information; 
  • payment-provider delays; 
  • rejected payments; 
  • insufficient funds; or 
  • payments sent to the wrong account. 

Where payment has not been received before the Holiday Club starts, First Kick CIC may refuse attendance until the payment issue has been resolved. 

First Kick CIC may recover any reasonable unpaid Fees or charges that are properly due under these Terms. 

 

  1. PRICING ERRORS AND BOOKING ERRORS

First Kick CIC may correct an obvious pricing, date, availability, Venue or programme error. 

Where an obvious error is identified before attendance, First Kick CIC may contact the Parent/Carer and offer the choice of: 

  • accepting the corrected Booking; 
  • transferring to a suitable alternative; or 
  • receiving a refund of the affected Fees. 

First Kick CIC will not be required to provide a Booking at an obviously incorrect price where the Parent/Carer knew or reasonably should have known that the price was incorrect. 

Parents/Carers are responsible for checking their Booking confirmation and notifying First Kick CIC promptly of any error. 

 

  1. KLARNA AND OTHER THIRD-PARTY PAYMENT METHODS

Where available, Parents/Carers may choose to pay for eligible Bookings using Klarna or another third-party payment provider. 

Choosing Klarna or another payment provider does not alter these Terms or First Kick CIC’s Booking, transfer, cancellation or refund policy. 

Any separate credit or payment agreement is between the Parent/Carer and the relevant payment provider and is subject to that provider’s eligibility criteria and terms. 

The Parent/Carer remains responsible for complying with any separate payment agreement. 

Where First Kick CIC approves a refund, the refund will normally be processed through the original payment method. 

The processing of a refund may be subject to the relevant payment provider’s procedures and timescales. 

First Kick CIC is not responsible for interest, late-payment fees or other charges arising under a separate agreement between the Parent/Carer and a payment provider, except where those charges arise directly from First Kick CIC’s breach of contract or legal obligations. 

 

  1. TAX-FREE CHILDCARE AND CHILDCARE-VOUCHER REFUNDS

Where payment was made through: 

  • Tax-Free Childcare; 
  • a childcare-voucher provider; 
  • an employer-supported childcare scheme; or 
  • another restricted childcare-payment scheme, 

any approved refund will normally be returned through the original scheme, provider or childcare account. 

First Kick CIC cannot normally refund those payments directly to the Parent/Carer by cash, bank transfer or another payment method. 

The Parent/Carer is responsible for providing any information reasonably required to process the refund through the correct scheme. 

Any refund remains subject to the rules and processing times of the relevant scheme or provider. 

 

  1. PAYMENT DISPUTES AND CHARGEBACKS

Parents/Carers should contact First Kick CIC promptly where they believe a payment has been taken incorrectly or where there is a dispute about a Booking. 

Where a chargeback, payment reversal or payment dispute is raised in relation to a valid Booking, First Kick CIC may pause or suspend the Booking while the matter is investigated. 

Where a payment is reversed but the relevant Booking remains valid, First Kick CIC may require the outstanding amount to be repaid before attendance. 

First Kick CIC may recover any Fees properly due under these Terms. 

Nothing in this section prevents a Parent/Carer from using a lawful chargeback, payment dispute or consumer remedy. 

 

  1. COOLING-OFF PERIOD

Holiday Club Bookings relate to services provided on specific dates or during specific periods. 

Where a Booking is for sports, leisure or recreational activities provided on a specific date or during a specific period, the statutory 14-day cancellation or cooling-off right that may apply to some online or telephone purchases does not apply. 

This means that a Parent/Carer does not have an automatic right to cancel an eligible Holiday Club Booking within 14 days merely because: 

  • the Booking was made online; 
  • the Booking was made over the telephone; or 
  • the Parent/Carer has changed their mind. 

Where the legal exemption does not apply to a particular Booking, the Parent/Carer will retain any cancellation rights provided by law. 

Nothing in these Terms affects any refund, cancellation right or other remedy to which the Parent/Carer is legally entitled. 

 

  1. PARENT/CARER CANCELLATIONS AND REFUNDS

12.1 General cancellation policy 

Holiday Club places are limited and are reserved for specific dates, Venues and Sessions. 

Once a Booking has been completed, the place is reserved for the Child and may prevent another family from booking that place. 

First Kick CIC may also commit costs based on confirmed Bookings, including: 

  • staffing; 
  • Venue hire; 
  • administration; 
  • equipment; 
  • food; 
  • resources; 
  • third-party charges; and 
  • programme-delivery costs. 

Holiday Club Bookings are therefore normally non-refundable once booked. 

Where a Parent/Carer cancels, First Kick CIC may retain some or all of the Fees to cover the losses and costs reasonably arising from the cancellation. 

This may include: 

  • staffing costs already committed; 
  • Venue costs already committed; 
  • administration and booking costs; 
  • equipment, food or programme costs; 
  • non-refundable third-party charges; 
  • the loss associated with a place that cannot reasonably be filled; and 
  • any other reasonable cost directly resulting from the cancellation. 

First Kick CIC will take reasonable steps to limit avoidable losses where appropriate, including making a cancelled place available to another family where reasonably practical. 

Where a place is successfully resold, or where First Kick CIC avoids costs because of the cancellation, this may be considered when determining whether any refund is due. 

In many circumstances, particularly where cancellation takes place close to the booked date, the costs and losses arising from the cancellation may mean that no refund is available. 

Nothing in this section allows First Kick CIC to retain an amount that it is not legally entitled to retain. 

12.2 Circumstances where refunds will not normally be provided 

A refund will not normally be provided where: 

  • the Parent/Carer changes their mind; 
  • the Child no longer wishes to attend; 
  • the Child is unable to attend due to illness or injury; 
  • the Child is on holiday; 
  • the Parent/Carer makes alternative childcare arrangements; 
  • family plans change; 
  • the Parent/Carer books the wrong date; 
  • the Parent/Carer books the wrong Venue; 
  • the Parent/Carer books the wrong programme or Session; 
  • the Parent/Carer books the wrong age group; 
  • incorrect booking information is provided; 
  • the Child is taken to or attends the wrong Venue; 
  • the Child does not attend; 
  • the Parent/Carer forgets the Booking; 
  • the Child arrives late; 
  • the Child leaves early; 
  • travel difficulties prevent attendance; 
  • the Child is refused attendance because they are unwell or contagious; 
  • required medication has not been provided; 
  • required medical or support information has not been provided; 
  • the Child does not have suitable clothing or footwear; 
  • essential medical, allergy, safeguarding, behavioural, personal-care or SEND information was not disclosed; 
  • the Child’s needs cannot safely be met because accurate information was not provided; 
  • the Child is removed or excluded because of serious or repeated behaviour; 
  • the conduct of a Parent/Carer results in the Booking being cancelled or attendance being refused; or 
  • the Parent/Carer or Child otherwise fails to comply with these Terms or First Kick CIC’s reasonable Policies and instructions. 

This section does not prevent First Kick CIC from considering exceptional circumstances at its discretion. 

12.3 Refund method 

Any approved refund will normally be returned through the original payment method. 

First Kick CIC may require reasonable information to identify and verify the original payment. 

Refund-processing times may vary depending on the bank, card provider, Booking System, payment provider or childcare-payment scheme used. 

Any refund will be limited to the amount actually paid to First Kick CIC for the affected Booking or Session. 

 

  1. TRANSFERS AND CREDITS

First Kick CIC may, at its discretion, allow a Booking to be transferred to another Holiday Club where: 

  • the request is received at least 7 days before the booked Session or programme starts; 
  • a suitable alternative place is available; 
  • staffing ratios allow the transfer; 
  • Venue capacity allows the transfer; 
  • the Child meets the relevant age and programme requirements; 
  • funding or eligibility conditions allow the transfer; 
  • the transfer does not create unreasonable additional costs; and 
  • First Kick CIC considers the transfer operationally practical. 

Transfers are not guaranteed. 

Requests received fewer than 7 days before the booked Session or programme starts will not normally be approved. 

A Booking may not be transferred directly between Parents/Carers or Children without First Kick CIC’s written agreement. 

Where the alternative Holiday Club costs more than the original Booking, the Parent/Carer must pay the difference before the transfer is confirmed. 

Where the alternative Holiday Club costs less, no refund of the difference will normally be provided unless First Kick CIC agrees otherwise. 

Any credit offered by First Kick CIC: 

  • has no cash value; 
  • cannot be exchanged for cash; 
  • cannot automatically be exchanged for a refund; 
  • cannot be sold; 
  • cannot be transferred to another person unless agreed; 
  • may be restricted to a named Child or family; 
  • must be used within the period stated; 
  • is subject to availability; and 
  • may be withdrawn where it was obtained through inaccurate or misleading information. 

Offering a transfer, refund or credit on one occasion does not create an entitlement to the same outcome for a future Booking. 

 

  1. PROMOTIONS, DISCOUNTS AND DUPLICATE BOOKINGS

Promotional codes, discounts and offers are subject to: 

  • their stated conditions; 
  • availability; 
  • eligibility requirements; 
  • expiry dates; and 
  • any programme restrictions. 

Promotional codes and discounts cannot normally be: 

  • applied retrospectively; 
  • exchanged for cash; 
  • transferred; or 
  • combined with another offer unless expressly stated. 

Parents/Carers are responsible for avoiding duplicate Bookings. 

Duplicate Bookings will be dealt with under the normal cancellation policy unless the duplicate Booking was caused by a confirmed fault in First Kick CIC’s Booking System. 

 

  1. CHANGES OR CANCELLATIONS BY FIRST KICK CIC

First Kick CIC may need to cancel, move, merge, shorten, delay or amend a Holiday Club where reasonably necessary. 

This may include circumstances involving: 

  • low booking numbers; 
  • staff illness; 
  • unexpected staff shortages; 
  • Venue closure; 
  • loss of Venue access; 
  • unsafe Venue or pitch conditions; 
  • adverse weather; 
  • public health concerns; 
  • safeguarding concerns; 
  • local authority requirements; 
  • school requirements; 
  • funder requirements; 
  • emergency works; 
  • power, heating or water failure; 
  • transport disruption; or 
  • events outside First Kick CIC’s reasonable control. 

Where reasonably possible, First Kick CIC will provide as much notice as practical. 

First Kick CIC may make reasonable changes without automatically creating a right to a refund where the main booked service can still be provided. 

This may include: 

  • moving the Holiday Club to a reasonable alternative Venue; 
  • changing the coach or staff team; 
  • changing the timetable; 
  • changing or adapting activities; 
  • moving activities indoors or outdoors; 
  • merging appropriate groups; 
  • changing rooms, pitches or activity areas; 
  • adjusting start or finish arrangements; 
  • reducing or adapting activity for safety reasons; or 
  • making other reasonable operational changes. 

When deciding whether an alternative Venue or arrangement is suitable, First Kick CIC may consider: 

  • the distance from the original Venue; 
  • transport and accessibility; 
  • the Child’s age and needs; 
  • the available facilities; 
  • the programme being delivered; 
  • start and finish times; 
  • safety; 
  • safeguarding; and 
  • the circumstances requiring the change. 

Where a change fundamentally alters the nature of the booked programme rather than merely adjusting the timetable, activities, staff or Venue, First Kick CIC will offer an appropriate alternative, transfer, credit or refund, taking account of the circumstances and the Parent/Carer’s statutory rights. 

Where First Kick CIC cancels a paid Session, it will normally try to offer one or more of the following: 

  • a suitable alternative Session; 
  • a suitable alternative Venue; 
  • a transfer to another Holiday Club; 
  • a credit for future use; or 
  • a refund for the affected paid Session. 

Where First Kick CIC cannot provide the booked paid Session or a suitable alternative, the Parent/Carer will be entitled to an appropriate refund for the service that has not been provided. 

Any refund will normally be limited to the Fees paid for the affected Session. 

First Kick CIC will not normally be responsible for indirect or consequential costs arising from a cancellation or change, including: 

  • travel costs; 
  • parking costs; 
  • loss of earnings; 
  • alternative childcare costs; 
  • accommodation costs; or 
  • other personal or third-party costs. 

Nothing in this section limits any liability that cannot legally be limited or excluded. 

 

  1. EMERGENCY EARLY CLOSURE

Where a Holiday Club must close early because of: 

  • a serious incident; 
  • an emergency; 
  • an unsafe Venue condition; 
  • a safeguarding concern; 
  • loss of utilities; 
  • severe weather; 
  • an instruction from the Venue, school, police, local authority or emergency services; or 
  • another significant safety concern, 

Parents/Carers must arrange prompt collection when contacted. 

First Kick CIC may contact emergency contacts where the Parent/Carer cannot be reached. 

Where a Child is not collected within a reasonable period, First Kick CIC may follow its uncollected-child and safeguarding procedures. 

Any refund, transfer or credit will be considered in accordance with: 

  • the part of the Session already delivered; 
  • the reason for the closure; 
  • any alternative arrangements offered; 
  • costs reasonably incurred; and 
  • the Parent/Carer’s statutory rights. 

 

  1. EVENTS OUTSIDE OUR CONTROL

First Kick CIC will not be responsible for a failure or delay in providing a Holiday Club where this is caused by an event outside its reasonable control. 

Such events may include: 

  • severe weather; 
  • flooding; 
  • fire; 
  • power failure; 
  • heating failure; 
  • water failure; 
  • Venue closure; 
  • industrial action; 
  • public health restrictions; 
  • transport disruption; 
  • police incidents; 
  • serious safeguarding incidents; 
  • local authority decisions; 
  • school decisions; 
  • government decisions or guidance; 
  • emergency works; 
  • war; 
  • terrorism; 
  • civil unrest; or 
  • another circumstance outside First Kick CIC’s reasonable control. 

Where possible, First Kick CIC will communicate changes as soon as reasonably practical and will try to provide a suitable alternative. 

Where the paid service cannot be provided, First Kick CIC will consider whether a refund, transfer, alternative Session or credit is appropriate, taking account of: 

  • the service that has not been provided; 
  • any costs that First Kick CIC has avoided or recovered; 
  • any alternative service offered; and 
  • the Parent/Carer’s statutory rights. 

First Kick CIC will not normally be responsible for indirect or consequential losses arising from an event outside its reasonable control. 

Nothing in this section affects legal rights or remedies that cannot lawfully be excluded. 

 

  1. FUNDED PLACES, HAF PLACES AND LOCAL AUTHORITY PLACES

Funded Places are subject to the rules set by the relevant: 

  • funder; 
  • local authority; 
  • school; 
  • grant provider; or 
  • partner organisation. 

A Funded Place may be withdrawn, amended or refused where: 

  • the Child does not meet the eligibility criteria; 
  • inaccurate or incomplete information has been provided; 
  • the Child repeatedly fails to attend without notice; 
  • the funder changes or withdraws the funding; 
  • the correct booking process has not been followed; 
  • the Parent/Carer does not comply with the funder’s requirements; 
  • the place has been booked more than once through different routes; 
  • the Child’s needs cannot safely be met; or 
  • continuing the place would breach a funding, safety or safeguarding requirement. 

Funded Places have no cash value and cannot be: 

  • refunded to the Parent/Carer; 
  • exchanged for money; 
  • transferred to another Child without approval; 
  • used outside the relevant funding period; or 
  • used for another programme unless the funder and First Kick CIC approve this. 

Where food is included as part of a funded programme, it will be provided in accordance with the relevant programme requirements. 

Parents/Carers must still provide full and accurate allergy, dietary and medical information. 

Where a Funded Place is no longer required, the Parent/Carer should notify First Kick CIC as soon as possible so that the place may be offered to another eligible Child. 

Repeated non-attendance without notice may be reported to the relevant funder and may affect eligibility for future Funded Places. 

 

  1. NON-ATTENDANCE AND WELFARE CHECKS

Parents/Carers should notify First Kick CIC as soon as possible where a Child will not attend a booked Session. 

Where a Child is expected but does not arrive, First Kick CIC may contact: 

  • the Parent/Carer; 
  • emergency contacts; 
  • the relevant school; 
  • the funder; or 
  • another person or organisation involved in the Child’s care. 

Where non-attendance creates a safeguarding or welfare concern, First Kick CIC may follow its safeguarding procedures and contact an appropriate agency. 

Non-attendance does not normally create a right to a refund. 

 

  1. ARRIVAL, COLLECTION AND LATE COLLECTION

Parents/Carers are responsible for ensuring that Children arrive and are collected: 

  • at the correct Venue; 
  • on the correct date; 
  • at the correct times; and 
  • in accordance with the stated arrival and collection arrangements. 

Children must be signed in and signed out by an authorised adult unless First Kick CIC has agreed an alternative arrangement in writing. 

Parents/Carers must inform First Kick CIC in advance where a different adult will collect the Child. 

First Kick CIC may request identification or other confirmation before releasing a Child. 

First Kick CIC may refuse to release a Child to a person who: 

  • has not been authorised; 
  • cannot provide suitable identification; 
  • appears to be under the influence of alcohol or drugs; 
  • behaves aggressively or inappropriately; 
  • appears unable to care for the Child safely; or 
  • raises a safeguarding concern. 

Children must be collected no later than the advertised Holiday Club finish time. 

A late collection charge of £1 per minute, per Child applies for every minute after the advertised closing time. 

For example, where the Holiday Club closes at 3:30pm and the Child is collected at 3:42pm, a late collection charge of £12 will apply. 

The charge reflects the additional staffing, supervision, administration and operational costs associated with late collection. 

Late collection charges must be paid before the Child attends a future First Kick CIC Holiday Club unless otherwise agreed in writing. 

Repeated late collection may result in future Bookings being refused or cancelled. 

Parents/Carers must contact First Kick CIC as soon as possible where they expect to be late. 

Notifying First Kick CIC of a delay does not automatically remove the late collection charge. 

First Kick CIC may waive or reduce the charge in exceptional circumstances at its discretion. 

Where a Child is not collected and First Kick CIC cannot contact the Parent/Carer or emergency contacts, First Kick CIC may contact: 

  • children’s social care; 
  • the police; 
  • the Venue; 
  • the local authority; or 
  • another appropriate safeguarding agency. 

 

  1. SEPARATED PARENTS, PARENTAL RESPONSIBILITY AND COURT ORDERS

First Kick CIC will normally presume that a person with parental responsibility may: 

  • receive relevant information about the Child; 
  • collect the Child; and 
  • make appropriate decisions concerning the Child, 

unless First Kick CIC has been provided with reliable written evidence that limits or prevents this. 

Parents/Carers must inform First Kick CIC of any relevant: 

  • court order; 
  • prohibited-steps order; 
  • child-arrangements order; 
  • collection restriction; 
  • non-molestation order; 
  • safeguarding plan; or 
  • other legal restriction. 

First Kick CIC may request a copy of any relevant order or written arrangement. 

First Kick CIC cannot mediate private family disputes. 

Where there is uncertainty, conflicting instructions or a safeguarding concern, First Kick CIC may: 

  • delay releasing the Child; 
  • seek legal or safeguarding advice; 
  • contact the police; 
  • contact children’s social care; or 
  • take another step reasonably necessary to protect the Child. 

Parents/Carers are responsible for promptly notifying First Kick CIC where any legal or collection arrangement changes. 

 

  1. INDEPENDENT TRAVEL

Children may only travel to or from a Holiday Club independently where: 

  • this has been requested by the Parent/Carer; 
  • the request has been made in writing; 
  • First Kick CIC has agreed to the arrangement; and 
  • First Kick CIC considers the arrangement safe and appropriate. 

First Kick CIC may refuse independent travel based on: 

  • the Child’s age; 
  • maturity; 
  • SEND or additional needs; 
  • the Venue; 
  • the proposed route; 
  • the Session finish time; 
  • weather conditions; 
  • safeguarding concerns; 
  • local authority or school rules; or 
  • another relevant safety consideration. 

Where independent travel is agreed, the Parent/Carer remains responsible for assessing whether the journey is suitable and safe. 

First Kick CIC’s responsibility will normally end when the Child is signed out or released at the agreed time and in accordance with the agreed arrangement. 

First Kick CIC may withdraw an independent-travel arrangement where circumstances change or a safety or safeguarding concern arises. 

 

  1. OFF-SITE ACTIVITIES AND TRANSPORT

First Kick CIC will inform Parents/Carers where a programme includes planned: 

  • off-site activities; 
  • organised transport; 
  • walking to another location; or 
  • travel between separate Venues. 

Any additional consent reasonably required must be completed before the Child participates. 

Short supervised movement between pitches, rooms, play areas or buildings forming part of the Venue or normal programme may take place without separate consent where: 

  • this is included within the programme arrangements; 
  • appropriate supervision is provided; and 
  • suitable risk assessments are in place. 

First Kick CIC will not transport a Child in a vehicle unless: 

  • the transport forms part of the agreed programme; 
  • appropriate consent has been obtained where required; 
  • suitable safeguarding and safety arrangements are in place; and 
  • the transport complies with applicable law and First Kick CIC’s Policies. 

 

  1. PARENT/CARER RESPONSIBILITIES

Parents/Carers must: 

  • provide accurate and up-to-date information; 
  • ensure the Child is fit and well enough to attend; 
  • disclose relevant medical information; 
  • disclose allergies and dietary requirements; 
  • disclose SEND and additional needs; 
  • disclose relevant behavioural or safeguarding information; 
  • disclose toileting and personal-care needs; 
  • provide suitable clothing and footwear; 
  • provide a refillable water bottle; 
  • provide sufficient food and snacks unless food is included; 
  • apply sun cream before arrival where appropriate; 
  • provide additional sun protection where needed; 
  • provide correctly labelled medication; 
  • provide clear medication instructions; 
  • ensure emergency medication is available; 
  • collect the Child on time; 
  • remain reasonably contactable; 
  • ensure emergency contacts are available; 
  • treat staff and others respectfully; and 
  • follow First Kick CIC’s reasonable Policies and instructions. 

Parents/Carers must not send a Child to a Holiday Club where the Child: 

  • is contagious; 
  • has sickness or diarrhoea; 
  • has a high temperature; 
  • has an infectious illness; 
  • is too unwell to participate; 
  • requires medication that has not been provided; or 
  • otherwise cannot safely take part. 

Parents/Carers must notify First Kick CIC promptly where relevant information changes before or during a programme. 

 

  1. INFECTIOUS ILLNESS AND RETURN TO ATTENDANCE

First Kick CIC may apply relevant public-health guidance and reasonable exclusion periods following: 

  • sickness; 
  • diarrhoea; 
  • infectious illness; 
  • a high temperature; 
  • communicable disease; or 
  • another condition that may place others at risk. 

First Kick CIC may refuse attendance or request collection where a Child appears too unwell to participate safely or may be contagious. 

Where reasonably necessary for safety, First Kick CIC may request confirmation that the Child is fit to return. 

A refund will not normally be provided where attendance is refused because the Child is unwell or contagious. 

 

  1. CLOTHING, FOOTWEAR AND PERSONAL BELONGINGS

Children must attend wearing suitable clothing and footwear for: 

  • sport; 
  • physical activity; 
  • the Venue; 
  • the planned activities; and 
  • the expected weather conditions. 

For football-based Sessions, suitable trainers, football boots, shin pads or other equipment may be required depending on the Venue and activity. 

First Kick CIC may adapt or restrict participation where clothing or footwear creates a safety concern. 

First Kick CIC is not responsible for loss of or damage to personal belongings unless caused by First Kick CIC’s negligence or another legal breach. 

Children should not bring: 

  • valuables; 
  • unnecessary electronic devices; 
  • large amounts of money; 
  • prohibited items; or 
  • belongings that are not needed for the Holiday Club. 

All clothing, drinks bottles, lunch boxes, medication and personal belongings should be clearly labelled with the Child’s name. 

First Kick CIC may store found property for a reasonable period before disposing of or donating unclaimed items. 

 

  1. MOBILE PHONES, SMARTWATCHES AND CONNECTED DEVICES

Children must not use mobile phones, smartwatches, cameras or other connected devices to: 

  • photograph or record other children; 
  • photograph or record staff; 
  • access inappropriate content; 
  • contact other children without permission; 
  • disrupt activities; or 
  • breach safeguarding or privacy requirements. 

First Kick CIC may require devices to remain: 

  • switched off; 
  • stored in a bag; 
  • handed to a member of staff; or 
  • otherwise unused during the Session. 

First Kick CIC cannot guarantee the security of a device brought to the Venue. 

Parents/Carers should contact First Kick CIC directly where they need to pass an urgent message to a Child during a Session. 

 

  1. FOOD, DRINK AND ALLERGIES

Parents/Carers must provide sufficient food and drink for the Child unless food is expressly included as part of the programme. 

Parents/Carers must inform First Kick CIC of all: 

  • allergies; 
  • intolerances; 
  • dietary requirements; 
  • medical dietary needs; and 
  • cultural or religious dietary requirements relevant to the Child’s care. 

This information must be provided before attendance and updated where necessary. 

First Kick CIC may restrict particular foods or ingredients for allergy, safety or Venue reasons. 

First Kick CIC will take reasonable steps to manage known allergy information, but Parents/Carers remain responsible for ensuring that the information supplied is accurate, complete and current. 

First Kick CIC cannot guarantee that a Venue, group or programme will be completely free from allergens. 

Food must be suitable for the Child to eat independently unless alternative arrangements have been agreed. 

Parents/Carers should not send food that requires refrigeration, heating or preparation unless this has been agreed in advance. 

 

  1. SUN PROTECTION

Parents/Carers must apply suitable sun cream before the Child arrives where appropriate. 

Where reapplication may be required, Parents/Carers should provide: 

  • clearly labelled sun cream; 
  • a sun hat; 
  • suitable clothing; and 
  • sufficient drinks. 

Depending on the Child’s age and First Kick CIC’s procedures, staff may remind or supervise Children to apply their own sun cream. 

Any staff assistance with applying sun cream must be agreed in accordance with First Kick CIC’s Policies and any consent requirements. 

First Kick CIC may adapt activities, increase shade or rest periods, or reduce time outdoors during hot weather. 

 

  1. MEDICAL CONDITIONS AND MEDICATION

Parents/Carers must tell First Kick CIC about any: 

  • medical condition; 
  • illness; 
  • injury; 
  • allergy; 
  • medication requirement; 
  • disability; 
  • health concern; or 
  • emergency-care requirement 

that may affect the Child during the Holiday Club. 

Medication must: 

  • be clearly labelled; 
  • be provided in its original packaging where reasonably possible; 
  • be within its expiry date; 
  • include the Child’s name; 
  • include clear written instructions; and 
  • be handed directly to an appropriate member of staff. 

First Kick CIC staff will only administer medication where: 

  • the required consent has been provided; 
  • the instructions are sufficiently clear; 
  • the medication is appropriately labelled; 
  • the medication can be stored and administered safely; and 
  • the arrangement complies with First Kick CIC’s Policies. 

Emergency medication, including inhalers, adrenaline auto-injectors or other prescribed emergency medication, must be provided where required. 

A Child who requires emergency medication may be refused attendance or require immediate collection where the medication: 

  • is unavailable; 
  • is expired; 
  • is damaged or unusable; 
  • is incorrectly labelled; or 
  • does not accompany the Child as agreed. 

In an emergency, First Kick CIC may: 

  • provide appropriate first aid; 
  • seek medical advice; 
  • contact emergency services; 
  • accompany the Child for treatment where necessary; and 
  • act in the Child’s best interests until the Parent/Carer is available. 

 

  1. TOILETING, CONTINENCE AND PERSONAL CARE

Parents/Carers must provide accurate information about any toileting, continence or personal-care support the Child requires. 

Unless otherwise agreed in advance, Children should be able to manage their usual toileting needs independently, with age-appropriate verbal prompting where required. 

Where a Child requires: 

  • nappies; 
  • continence products; 
  • changing assistance; 
  • intimate-care support; 
  • assistance with clothing; 
  • cleaning following an accident; or 
  • another form of personal care, 

this must be discussed and agreed before attendance. 

First Kick CIC may require: 

  • an individual care plan; 
  • written consent; 
  • a risk assessment; 
  • additional staffing; 
  • specific equipment; 
  • spare clothing; 
  • continence products; or 
  • other reasonable arrangements. 

Parents/Carers must provide any agreed personal-care supplies. 

Parents/Carers should provide clearly labelled spare clothing where accidents may occur. 

First Kick CIC may contact the Parent/Carer to collect the Child where: 

  • an unexpected personal-care need arises; 
  • the required supplies have not been provided; 
  • the agreed support cannot be delivered safely; or 
  • staff cannot appropriately meet the Child’s needs. 

All personal and intimate care will be managed in accordance with First Kick CIC’s Policies, safeguarding procedures and the Child’s dignity and welfare. 

 

  1. SEND, ADDITIONAL NEEDS AND REASONABLE ADJUSTMENTS

First Kick CIC is committed to inclusive provision and will consider reasonable adjustments where appropriate. 

Parents/Carers must provide full and accurate information about any: 

  • SEND; 
  • disability; 
  • medical need; 
  • behavioural need; 
  • emotional need; 
  • communication need; 
  • sensory need; 
  • mobility need; 
  • personal-care need; 
  • supervision need; or 
  • other support requirement 

before the Booking is completed or as soon as the need becomes known. 

Reasonable adjustments will depend on factors including: 

  • the Child’s individual needs; 
  • the Venue; 
  • the activity type; 
  • staffing levels; 
  • staff training; 
  • staff-to-child ratios; 
  • available funding; 
  • safety; 
  • risk assessment; 
  • safeguarding; 
  • the needs of other children; and 
  • the resources reasonably available. 

First Kick CIC may need to: 

  • request further information; 
  • speak with the Parent/Carer; 
  • speak with relevant professionals where appropriate consent or lawful authority exists; 
  • complete a risk assessment; 
  • agree a support plan; 
  • undertake a pre-visit; 
  • adapt activities; 
  • increase staffing; 
  • obtain additional funding; or 
  • assess whether the provision is suitable. 

First Kick CIC may refuse, pause or withdraw a place where: 

  • essential information has not been provided; 
  • inaccurate or misleading information has been provided; 
  • a safe support plan cannot be agreed; 
  • necessary funding or staffing is unavailable; 
  • the Child’s needs cannot reasonably and safely be met; 
  • attendance would create a significant safety, safeguarding or welfare risk; 
  • required medication, equipment or support is unavailable; or 
  • the agreed support arrangements are not followed. 

Any decision will be based on the individual circumstances and will take account of: 

  • safety; 
  • suitability; 
  • safeguarding; 
  • welfare; 
  • reasonable-adjustment duties; 
  • staffing; 
  • funding; and 
  • the available facilities and resources. 

First Kick CIC will not refuse a Child solely because they have a disability or SEND. 

 

  1. BEHAVIOUR EXPECTATIONS

Children, Parents/Carers and anyone attending a Venue must behave respectfully towards: 

  • staff; 
  • volunteers; 
  • other children; 
  • other Parents/Carers; 
  • Venue staff; and 
  • members of the public. 

Children must follow reasonable: 

  • staff instructions; 
  • Venue rules; 
  • safety instructions; 
  • safeguarding instructions; and 
  • behaviour expectations. 

Behaviour that may result in intervention, removal, exclusion or refusal of future Bookings includes: 

  • physical aggression; 
  • threatening behaviour; 
  • bullying; 
  • discriminatory language or conduct; 
  • racist, sexist, homophobic or otherwise abusive language; 
  • swearing at staff or children; 
  • repeated refusal to follow instructions; 
  • dangerous or reckless behaviour; 
  • leaving the group or Venue without permission; 
  • deliberately damaging property; 
  • bringing prohibited or unsafe items; 
  • theft; 
  • inappropriate sexualised behaviour; 
  • harassment; or 
  • behaviour that places the Child or others at risk. 

Where appropriate, First Kick CIC may use: 

  • reminders; 
  • redirection; 
  • warnings; 
  • adapted activities; 
  • time away from an activity; 
  • discussions with the Child; 
  • Parent/Carer communication; 
  • behaviour plans; and 
  • other reasonable behaviour-support strategies. 

First Kick CIC may remove a Child immediately where behaviour creates a serious safety, safeguarding or welfare concern. 

Where a Child is removed or excluded, the Parent/Carer may be required to collect the Child immediately. 

No refund will normally be provided where a Child is removed or excluded because of serious or repeated behaviour, particularly where staffing, Venue and programme costs have already been committed. 

Any amount retained will remain subject to applicable consumer law and the circumstances of the cancellation. 

 

  1. PARENT/CARER CONDUCT

Parents/Carers must treat First Kick CIC staff, Venue staff, other Parents/Carers and children respectfully. 

First Kick CIC will not tolerate: 

  • aggressive behaviour; 
  • threats; 
  • verbal abuse; 
  • physical abuse; 
  • harassment; 
  • intimidation; 
  • discriminatory language; 
  • repeated unreasonable demands; 
  • malicious or knowingly false allegations; 
  • filming staff or children without permission; 
  • unauthorised access to restricted areas; or 
  • behaviour that disrupts the safe running of the Holiday Club. 

First Kick CIC may: 

  • ask a Parent/Carer to leave; 
  • restrict access to the Venue; 
  • require communication to take place through a named person or in writing; 
  • refuse future Bookings; 
  • cancel existing Bookings; or 
  • contact an appropriate authority. 

Where Parent/Carer conduct creates a safety, welfare or safeguarding concern, First Kick CIC may contact: 

  • the police; 
  • the Venue; 
  • the local authority; 
  • children’s social care; 
  • a funder; 
  • a school; or 
  • another relevant agency. 

Where a Booking is cancelled because of Parent/Carer conduct, any refund will be considered in accordance with the circumstances, First Kick CIC’s resulting losses and applicable consumer law. 

 

  1. SAFEGUARDING

The safety and welfare of children is First Kick CIC’s priority. 

First Kick CIC operates safeguarding procedures and expects staff, volunteers, Parents/Carers, visitors and children to follow relevant safeguarding rules. 

Where First Kick CIC has a safeguarding concern, it may take any action reasonably necessary to protect a Child or other children. 

This may include: 

  • speaking to the Child; 
  • contacting the Parent/Carer; 
  • contacting emergency contacts; 
  • recording the concern; 
  • contacting First Kick CIC’s Designated Safeguarding Lead; 
  • contacting children’s social care; 
  • contacting the police; 
  • contacting the Local Authority Designated Officer; 
  • contacting Ofsted where required; 
  • contacting a school, Venue or funder; or 
  • making another appropriate referral. 

First Kick CIC may share information without parental consent where this is reasonably necessary and lawful for safeguarding purposes. 

Safeguarding decisions will be made in the best interests of the Child and other children attending. 

Parents/Carers must not interfere with or obstruct a safeguarding procedure or investigation. 

 

  1. FIRST AID,ACCIDENTSAND INCIDENTS 

First Kick CIC will have appropriate first-aid arrangements in place. 

Parents/Carers will be informed of accidents or incidents involving their Child where appropriate. 

Minor injuries may be treated by appropriately trained staff. 

Accidents, injuries, medical incidents and significant behaviour or safeguarding incidents may be recorded. 

In the event of a serious accident, illness or emergency, First Kick CIC may: 

  • provide first aid; 
  • contact emergency services; 
  • seek medical advice; 
  • arrange emergency treatment; and 
  • take reasonable action before contacting the Parent/Carer where immediate action is required. 

Parents/Carers must ensure: 

  • emergency contact details are accurate; 
  • at least one contact is reasonably available during the Holiday Club; and 
  • First Kick CIC is informed of any relevant health information. 

Where required by law or regulation, First Kick CIC may report accidents or incidents to: 

  • Ofsted; 
  • the Health and Safety Executive; 
  • a local authority; 
  • a funder; 
  • a school; 
  • an insurer; or 
  • another relevant organisation. 

 

  1. ADVERSE WEATHER AND ACTIVITY CHANGES

Holiday Clubs may continue in wet, cold, hot or changing weather where First Kick CIC considers it safe to do so. 

First Kick CIC may: 

  • adapt activities; 
  • move activities indoors; 
  • move activities outdoors; 
  • reduce activity intensity; 
  • change the timetable; 
  • use shaded areas; 
  • increase rest and drink breaks; 
  • change equipment; 
  • shorten an activity; or 
  • make another reasonable safety adjustment. 

Parents/Carers must ensure Children attend with clothing, footwear and protection suitable for the expected conditions. 

This may include: 

  • waterproof clothing; 
  • warm clothing; 
  • sun hats; 
  • sun cream; 
  • additional drinks; or 
  • suitable footwear. 

Where weather or site conditions make delivery unsafe, First Kick CIC may cancel, delay, relocate or amend the Holiday Club. 

Any entitlement to a refund, transfer or credit will be considered in accordance with the cancellation provisions in these Terms and the Parent/Carer’s statutory rights. 

 

  1. PHOTOGRAPHY AND VIDEO

First Kick CIC may take photographs or videos for purposes including: 

  • internal records; 
  • safeguarding; 
  • incident review; 
  • staff training; 
  • quality assurance; 
  • programme reporting; 
  • funder reporting; and 
  • marketing. 

Parents/Carers will be asked to provide relevant photography or video consent as part of the Booking process. 

First Kick CIC will not knowingly use an identifiable image of a Child for public marketing where the relevant consent has been refused or withdrawn. 

Withdrawal of marketing consent will apply to future use where reasonably practical but may not require First Kick CIC to remove materials that have already been lawfully printed, distributed or published. 

Photographs or recordings needed for safeguarding, incident management, legal compliance or internal records may be processed without marketing consent where there is another lawful basis. 

Parents/Carers and visitors must not take photographs or videos of other children without permission. 

Parents/Carers must not publish images or videos of other children without permission from the relevant Parents/Carers. 

First Kick CIC may ask any person to stop filming or photographing at a Venue. 

 

  1. DATA PROTECTION

First Kick CIC will process personal data in accordance with its Privacy Policy and applicable data-protection law. 

First Kick CIC may collect and use personal information for purposes including: 

  • Bookings; 
  • payments; 
  • attendance records; 
  • emergency contact; 
  • safeguarding; 
  • medical support; 
  • SEND support; 
  • behaviour management; 
  • funding requirements; 
  • local authority reporting; 
  • regulatory requirements; 
  • complaints; 
  • quality assurance; 
  • insurance; 
  • legal compliance; and 
  • communication with Parents/Carers. 

Parents/Carers must ensure that personal information provided is accurate and up to date. 

Parents/Carers must have appropriate authority to provide personal information relating to the Child, emergency contacts and other individuals. 

First Kick CIC’s Privacy Policy is available at:

  1. COMMUNICATION

First Kick CIC may contact Parents/Carers by: 

  • email; 
  • telephone; 
  • text message; 
  • WhatsApp; 
  • Booking System notification; 
  • letter; or 
  • another reasonable method. 

Parents/Carers are responsible for: 

  • providing correct contact details; 
  • keeping contact details up to date; 
  • checking communications; 
  • checking spam or junk folders; and 
  • remaining contactable while the Child attends. 

First Kick CIC is not responsible for a missed communication where incorrect or outdated information was provided or where the Parent/Carer failed to check the communication method supplied. 

Operational communications about Bookings, safety, cancellations, Venue changes, payments, incidents or the Child’s care are not marketing communications. 

Parents/Carers may opt out of marketing communications at any time without preventing First Kick CIC from sending necessary operational communications. 

 

  1. COMPLAINTS

Parents/Carers should raise concerns promptly so that First Kick CIC has a reasonable opportunity to investigate and respond. 

Where appropriate, an initial concern may be raised with the Holiday Club lead or another appropriate member of staff. 

Formal complaints may be submitted by emailing:

The complaint should include, where possible: 

  • the Parent/Carer’s name; 
  • the Child’s name; 
  • the relevant Venue and date; 
  • a clear explanation of the concern; 
  • any supporting information; and 
  • the outcome sought. 

First Kick CIC will aim to acknowledge and investigate complaints within a reasonable timeframe. 

First Kick CIC may request additional information where needed. 

Where a Holiday Club is Ofsted-registered and a Parent/Carer is not satisfied with First Kick CIC’s response, the Parent/Carer may be able to complain to Ofsted. 

Nothing in this section prevents a Parent/Carer from contacting an appropriate safeguarding or regulatory body directly where necessary. 

 

  1. VENUE RULES

Parents/Carers, Children and visitors must follow all reasonable Venue rules. 

Venue rules may relate to: 

  • parking; 
  • access; 
  • arrival and collection areas; 
  • toilets; 
  • changing rooms; 
  • food; 
  • footwear; 
  • fire procedures; 
  • emergency procedures; 
  • restricted areas; 
  • photography; 
  • behaviour; and 
  • use of facilities or equipment. 

First Kick CIC is not responsible for Venue restrictions, parking arrangements, closures or third-party Venue decisions outside First Kick CIC’s reasonable control. 

Parents/Carers must not enter restricted areas or interfere with other Venue users. 

A breach of Venue rules may result in attendance being refused or the Parent/Carer being asked to leave. 

 

  1. CHANGES TO COACHES, TIMETABLES AND ACTIVITIES

First Kick CIC cannot guarantee that: 

  • the same coach will attend every day; 
  • the same staff members will be present throughout; 
  • a particular activity will take place; 
  • a particular room or pitch will be used; or 
  • the original timetable will remain unchanged. 

First Kick CIC may change: 

  • coaches; 
  • staff; 
  • groups; 
  • activities; 
  • rooms; 
  • pitches; 
  • equipment; or 
  • timetables 

where reasonably required for safety, staffing, weather, Venue or operational reasons. 

Replacement staff will be considered suitable by First Kick CIC for the duties they are carrying out. 

Reasonable changes that do not materially reduce the overall service will not automatically create a right to a refund. 

Where a change fundamentally alters the nature of the programme, the provisions in section 15 will apply. 

 

  1. STAFF,CONTRACTORSAND DELIVERY PARTNERS 

First Kick CIC may use appropriately appointed: 

  • employees; 
  • workers; 
  • volunteers; 
  • contractors; 
  • agency staff; or 
  • delivery partners 

to support or deliver a Holiday Club. 

Any person working with children will be subject to the safeguarding, suitability and checking requirements applicable to their role. 

First Kick CIC will remain responsible for the services it is contractually required to provide, subject to these Terms and applicable law. 

 

  1. EXCLUSION OR REFUSAL OF ATTENDANCE

First Kick CIC may refuse attendance, remove a Child, pause or cancel a Booking or refuse future Bookings where: 

  • payment has not been made; 
  • essential information has not been provided; 
  • inaccurate or misleading information has been provided; 
  • the Child is unwell or contagious; 
  • required medication has not been provided; 
  • required consent or instructions have not been provided; 
  • the Child’s needs cannot safely or reasonably be met; 
  • the Child’s behaviour creates a risk; 
  • the Parent/Carer behaves unacceptably; 
  • there is a safeguarding concern; 
  • Venue rules are breached; 
  • funding or eligibility requirements are not met; 
  • attendance would breach a legal or regulatory requirement; or 
  • First Kick CIC reasonably considers attendance unsafe or unsuitable. 

Any decision will take account of: 

  • safety; 
  • safeguarding; 
  • welfare; 
  • suitability; 
  • staffing; 
  • reasonable adjustments; 
  • Venue restrictions; and 
  • operational considerations. 

Where reasonably practical, First Kick CIC will explain the decision to the Parent/Carer. 

Any refund will be considered in accordance with: 

  • the circumstances leading to the refusal or cancellation; 
  • the proportion of the service already provided; 
  • the costs and losses reasonably incurred; 
  • whether the place can be filled; and 
  • applicable consumer law. 

 

  1. INSURANCE

First Kick CIC maintains insurance that it considers appropriate for the activities and provision it delivers. 

Details of relevant insurance may be made available on reasonable request. 

The existence of insurance does not remove the Parent/Carer’s responsibility to provide accurate information or to comply with these Terms and First Kick CIC’s Policies. 

 

  1. LIABILITY

First Kick CIC will provide Holiday Clubs with reasonable care and skill. 

Nothing in these Terms limits or excludes First Kick CIC’s liability for: 

  • death or personal injury caused by negligence; 
  • fraud; 
  • fraudulent misrepresentation; 
  • breach of statutory rights; or 
  • any other liability that cannot legally be limited or excluded. 

First Kick CIC is not responsible for loss of or damage to personal belongings unless caused by First Kick CIC’s negligence or breach of legal duty. 

First Kick CIC is not responsible for losses that were not reasonably foreseeable when the Booking was made. 

Subject to applicable law, First Kick CIC will not normally be responsible for indirect or consequential losses such as: 

  • loss of earnings; 
  • alternative childcare costs; 
  • travel costs; 
  • parking charges; 
  • accommodation costs; or 
  • other third-party expenses. 

Nothing in these Terms excludes liability where such exclusion would be unlawful. 

Parents/Carers acknowledge that sport, football, physical activity and childcare environments carry ordinary risks, including: 

  • trips; 
  • falls; 
  • bumps; 
  • collisions; 
  • minor injuries; 
  • accidental contact; and 
  • damage arising from normal participation. 

First Kick CIC will take reasonable steps to assess and manage foreseeable risks but cannot remove every ordinary risk associated with physical activity. 

 

  1. WEBSITE, ADVERTISING AND PUBLISHED INFORMATION

First Kick CIC takes reasonable care to ensure information on its: 

  • website; 
  • Booking System; 
  • social-media channels; 
  • emails; 
  • printed materials; and 
  • advertising 

is accurate when published. 

Information may occasionally contain errors or become outdated. 

First Kick CIC may: 

  • correct errors; 
  • update information; 
  • amend programmes; 
  • change Venues; 
  • change future prices; 
  • withdraw offers; or 
  • clarify published information. 

Where a material error affects an existing Booking, First Kick CIC will take reasonable steps to notify the affected Parent/Carer and provide an appropriate solution. 

Images used in marketing are illustrative and may not represent the exact: 

  • Venue; 
  • activity; 
  • staff team; 
  • facilities; or 
  • programme delivered. 

Promotional offers may be subject to separate eligibility requirements, expiry dates and availability. 

 

  1. POLICIES

These Terms should be read alongside First Kick CIC’s relevant Policies, including those relating to: 

  • safeguarding; 
  • health and safety; 
  • first aid; 
  • medication; 
  • complaints; 
  • behaviour; 
  • SEND; 
  • intimate care; 
  • data protection; 
  • photography and video; 
  • adverse weather; 
  • missing children; 
  • uncollected children; 
  • emergency evacuation; and 
  • lockdown. 

Policies may be updated where reasonably necessary to reflect: 

  • changes in law; 
  • regulatory requirements; 
  • safeguarding guidance; 
  • operational learning; 
  • local authority requirements; 
  • funder requirements; or 
  • good practice. 

Where there is a conflict between these Terms and a statutory, safeguarding, Ofsted, local authority, funder or legal requirement, the statutory or regulatory requirement will take priority. 

 

  1. CHANGES TO THESE TERMS

First Kick CIC may update these Terms from time to time. 

The Terms in force when a Booking is made will normally apply to that Booking. 

A later change may apply to an existing Booking where the change is reasonably required because of: 

  • a change in law; 
  • a regulatory requirement; 
  • a safeguarding requirement; 
  • an Ofsted requirement; 
  • a local authority requirement; 
  • a funder requirement; 
  • a Venue requirement; or 
  • another important safety or operational reason. 

First Kick CIC will take reasonable steps to notify affected Parents/Carers of a material change that applies to an existing Booking. 

A change will not remove statutory rights or retrospectively impose an unfair financial obligation on a Parent/Carer. 

 

  1. SEVERABILITY

If any provision of these Terms is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision will be treated as removed or modified only to the extent necessary. 

The remaining provisions will continue to apply. 

 

  1. FAILURE TO ENFORCE A TERM

If First Kick CIC does not immediately enforce a provision of these Terms, this does not mean that First Kick CIC has waived the right to enforce that provision later. 

Any waiver must be confirmed in writing by an authorised representative of First Kick CIC. 

 

  1. THIRD-PARTY RIGHTS

These Terms form an agreement between First Kick CIC and the Parent/Carer. 

Unless the law requires otherwise, a person who is not a party to the agreement does not have a right to enforce these Terms. 

 

  1. GOVERNING LAW

These Terms and Conditions are governed by the laws of England and Wales. 

Any dispute will be subject to the jurisdiction of the courts of England and Wales, subject to any mandatory consumer right to bring a claim in another applicable part of the United Kingdom. 

 

  1. AGREEMENT

By booking, paying for, accepting or attending a First Kick CIC Holiday Club, the Parent/Carer confirms that they: 

  • have read and accepted these Terms and Conditions; 
  • have provided accurate and complete information; 
  • will notify First Kick CIC if relevant information changes; 
  • understand the Booking, cancellation, transfer and refund provisions; 
  • understand that the statutory 14-day cooling-off period may not apply where the specific-date leisure-services exemption applies; 
  • understand their responsibilities; 
  • agree to follow First Kick CIC’s reasonable Policies and procedures; and 
  • understand that these Terms apply regardless of the payment method selected. 

Nothing in this agreement affects the Parent/Carer’s statutory rights.
